Are you allowed to enter a level crossing if the barriers have not been completely lifted?

Show the correct answer

Correct answer

NO

Explanation

In the video, you are approaching a level crossing in a town; the barriers are moving - they are just going up - and a cyclist is riding in front of you towards the crossing. You are not allowed to drive onto the level crossing if the barriers have not finished going up. The answer is: no.

The Road Traffic Act prohibits a driver from driving around lowered barriers or half-barriers and from driving onto a level crossing if they have started to go down or have not finished going up. A moving barrier means that the crossing equipment is still working: a rising barrier may stop and come down again because of another train, and a car that goes under it too early may be hit by the arm or trapped on the tracks. Until the barriers are fully upright and the red light of the signal goes out, you wait before the crossing, behind the signal or the stop line. The Act also requires you to exercise particular caution when approaching and going over a level crossing, and before driving onto the tracks to make sure that no rail vehicle is approaching - even when the barriers are already up. You drive on only when there is room beyond the crossing to leave it straight away.

Legal basis: Art. 28 para. 1 and para. 3 point 1 and 2 of the Road Traffic Act (Prawo o ruchu drogowym)
