Is it permitted in the presented situation to overtake the vehicle visible?
Show the correct answer
Correct answer
YES
Explanation
In the photo you are driving in the left lane of a wide roadway in a city, towards a flyover; ahead of you there is a pedestrian crossing with traffic lights, the traffic lights show a green light, and a silver car is driving over the crossing in the right lane. Overtaking the visible vehicle is allowed here. The answer is: yes.
The Road Traffic Act prohibits overtaking a vehicle on a pedestrian crossing and immediately before it, but with the exception of a crossing where traffic is controlled - and a crossing with traffic lights is exactly such a crossing. A green light means that pedestrians have a red signal and do not step onto the roadway, so there is no risk that the vehicle you are overtaking will hide a person stepping onto the crossing; for the same reason the Act allows overtaking at a junction where traffic is controlled. On a roadway with two lanes in one direction, overtaking simply means going past a vehicle in the next lane, without moving into the opposite lane. However, you check whether the silver car is signalling a lane change, keep a lateral clearance and remember that the green signal does not allow you to enter if this would make it difficult for a pedestrian to leave the roadway.
