Question no. 9366 3 pts basic B

In the presented situation, are you permitted to stop on the pavement before the sign?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving along a street in a town; on the right-hand side, on a post, there is sign B-36 "no stopping" with plate T-25c, whose downward arrow means that the ban ends at this place. You must not stop on the pavement before the sign - the ban applies before the sign and also covers the pavement. The answer is: no.

The Regulation on road signs and signals states that the ban shown by sign B-36 applies to the side of the road on which the sign stands - so also to the pavement on that side; plate T-25c shows the end of the ban, so before the sign the ban still applies. The Road Traffic Act allows a passenger car to stop on a footway (droga dla pieszych), that is on the pavement, with the wheels of one side or the front axle only on condition that there is no ban on stopping or parking on that section of the roadway, the pavement is at least 1.5 m wide and pedestrians will not be obstructed, and the car does not block traffic on the roadway. The first condition is not met here - driving onto the pavement does not get around sign B-36. Beyond the sign, when the pavement is wide enough and there are no other bans, such stopping will be allowed.

Legal basis: § 28 para. 2, para. 3 point 1 and para. 7 of the Regulation on road signs and signals; Art. 47 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
