In the situation presented. are you obliged to exercise special caution, stop the vehicle and make sure that no rail vehicle is approaching?

Show the correct answer

Correct answer

YES

Explanation

In the photo you are approaching a level crossing without barriers in a town; on the right there is a double St Andrew's cross G-4 with sign B-20 "STOP", and the tracks cross the roadway just in front of you. You must exercise particular caution, stop the vehicle and make sure that no rail vehicle is approaching. The answer is: yes.

The Road Traffic Act requires a driver approaching a level crossing to exercise particular caution, and before entering the tracks to make sure that no rail vehicle is approaching. The Regulation on road signs and signals states that sign B-20 placed in front of the tracks means no entry without stopping, and cross G-4 marks the stopping place at a multi-track crossing without barriers. At such a crossing, nobody and nothing will stop you from driving in front of a train - there are no barriers or signals, there is only your attention. You stop in front of the cross, open the window, look and listen in both directions; you remember that after one train has passed, another may be coming on the second track, and you move off only when both tracks are clear.

Legal basis: Art. 28 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 21 para. 1 and 4 and § 78 para. 5 of the Regulation on road signs and signals
