Are you obliged in each case, to stop the vehicle before entering such an intersection?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are approaching a junction in a town; on the right there is sign A-7 "give way", and below it C-2 "turn right beyond the sign"; directly in front of you there is a silver car with its brake lights on, waiting to enter, cars are driving along the intersecting road, and a red car is coming from the opposite direction. You are not obliged to stop your vehicle every time before entering such a junction - A-7 requires you to give way, and you only have to stop when it is necessary. The answer is: no.

The Regulation on road signs and signals states that sign A-7 warns of a junction with a priority road, and that a minor road is a road marked with this sign, on which you must give way to those driving on the main road; unconditional stopping, on the other hand, is required by sign B-20 "STOP". Giving way means not moving if your movement could force another driver to change direction or lane or to change speed significantly. If the intersecting road is empty, you enter without stopping; when vehicles are driving along it, as here, you slow down and stop if necessary - just like the silver car in front of you. You turn right because sign C-2 requires it.

Legal basis: § 5 para. 5, § 1 para. 2 point 2, § 21 para. 1 and § 35 para. 1 of the Regulation on road signs and signals; Art. 2 point 23 of the Road Traffic Act (Prawo o ruchu drogowym)
