In this situation, are you obliged to adhere to the "give way" sign?

Show the correct answer

Correct answer

NO

Explanation

In the photo a tram is approaching a junction where the tracks branch; next to the track there is sign A-7 "give way", and under it tram traffic lights showing a vertical bar, which means permission to enter; a pedestrian is walking along the pavement on the right. In this situation you are not obliged to follow the "give way" sign - the answer is NO.

Light signals have priority over road signs that govern right of way. As long as the tram traffic lights are working and allow you to go, sign A-7 does not apply - it will start to apply when the traffic lights are switched off. When driving through, however, you remain careful: you let pedestrians on the crossing pass and watch for vehicles that might enter the tracks against the signals. Where the tracks branch, you also make sure that the points (switch) are set for your direction of travel.

Legal basis: Art. 5 para. 3 and Art. 26 para. 1a of the Road Traffic Act (Prawo o ruchu drogowym); § 104 para. 1 point 1 of the Regulation on road signs and signals
