Question no. 2420 1 pts basic BAA1A2AMB1CC1DD1T

Are you allowed to leave the scene of the accident because you believe that the perpetrator of the accident will give first aid to the injured person?

Show the correct answer

Correct answer

NO

Explanation

In the video the car driving in front of you hits a pedestrian, who is lying on the roadway. You are at the scene of the incident and you see a person whose life may be in danger. You must not drive away just because you assume that the person who caused the accident will take care of the casualty - you do not know whether he will do it, whether he knows how to, or whether he is in shock himself.

The Criminal Code provides a penalty of up to 3 years' imprisonment for anyone who does not help a person in a situation of direct danger to life or of serious harm to health, although they could have done so without putting themselves at risk. The State Emergency Medical Services Act obliges a witness of such an incident to notify the emergency services without delay. So you stop safely, switch on your hazard warning lights, call 112 and help as well as you can until the rescuers arrive.

Legal basis: Art. 162 § 1 of the Criminal Code; Art. 4 of the State Emergency Medical Services Act
