Question no. 13159 3 pts basic BAA1A2AMB1CC1DD1T

In this situation, are you permitted to overtake the vehicle in front of you from the right?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving in town on a one-way roadway (sign D-3) with several lanes; ahead of you in the same lane a white car is braking, because you are approaching a pedestrian crossing marked with D-6 signs, and on the left a dark car is overtaking you. In this situation you are not allowed to overtake the white car on the right. The answer is: no.

The Road Traffic Act allows overtaking on the right on a one-way roadway with marked lanes, but only if the general conditions for overtaking are met, and a separate rule prohibits overtaking a vehicle on a pedestrian crossing and immediately before it, except at a crossing where traffic is controlled. The crossing in the video has no traffic lights, and the white car is braking just before the crossing - a manoeuvre made now would happen exactly in the prohibited place, and on the right side at that - and a pedestrian stepping off the right-hand pavement will first step exactly into the right-hand lane. The direction of overtaking is not the problem here; the problem is the place. You stay behind the white car, slow down together with it, check both pavements, and start any overtaking only after the crossing, when there is free space in the right-hand lane.

Legal basis: Art. 26 para. 3 point 1 and para. 1 and Art. 24 para. 10 point 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 44 para. 1 and § 47 para. 1 and 4 of the Regulation on road signs and signals
