In this situation, are you only obliged to be cautious?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving along a town street towards a pedestrian crossing with a traffic island; there are no pedestrians on the crossing. Your duty is not just ordinary caution - particular caution is required. The answer is: no.

The Road Traffic Act requires a driver approaching a pedestrian crossing to exercise particular caution - this duty applies regardless of whether any pedestrians can be seen at the moment. The Act distinguishes two levels: ordinary caution, which every road user must exercise at all times, and particular caution, defined as caution that involves increasing attention and adapting behaviour to the changing conditions and situations on the road, to a degree that allows a sufficiently quick reaction. A pedestrian crossing is one of the places where the Act requires this higher level, like a junction, a level crossing or overtaking. An empty crossing does not release you from it, because a pedestrian may appear at any moment - from behind the traffic island, the bollards or a parked car. "Only caution" is not enough: before the crossing you watch both pavements, keep your foot over the brake and drive at a speed that allows you to stop before someone who steps onto the crossing.

Legal basis: Art. 26 para. 1, Art. 3 para. 1 and Art. 2 point 22 of the Road Traffic Act (Prawo o ruchu drogowym)
