In this situation, is it enough if you only exercise extreme caution?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving along a town street in an area used by many children; on the right there is sign D-6 with plate T-27 on a yellow background, ahead of you on a post there are signs A-17 "children" and B-33 "30", and further on there is a pedestrian crossing. It is not enough to exercise only particular caution. The answer is: no.

The Road Traffic Act requires a driver approaching a pedestrian crossing to exercise particular caution, to reduce speed so as not to endanger a pedestrian who is on the crossing or entering it, and to give way to a pedestrian on the crossing or entering it. These are three duties at once, and particular caution is only the first of them; in addition, there is the 30 km/h limit from sign B-33, the ban on overtaking on the crossing and immediately before it, and the ban on passing (going around) a vehicle that has stopped to give way to a pedestrian. The Regulation on road signs and signals states that plate T-27 indicates a crossing used particularly often by children - they run onto the roadway without looking around and are shorter than parked cars, so just "being careful" is not enough: you must drive slowly enough to stop before a child you cannot see yet.

Legal basis: Art. 26 para. 1 and para. 3 point 1-2 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 4 and 5 and § 27 para. 1 of the Regulation on road signs and signals
