Are you allowed to haul a vehicle being driven by an intoxicated person?

Show the correct answer

Correct answer

NO

Explanation

The photo shows towing: a car with its lights on is connected by a tow rope to the towing vehicle. You are not allowed to tow a vehicle driven by a person after drinking alcohol. The answer is: no.

The Road Traffic Act prohibits a person from driving a vehicle when intoxicated, after drinking alcohol or after using a substance that acts in a similar way to alcohol, and it separately prohibits towing a vehicle driven by such a person. The driver of a towed vehicle really is driving: they must steer, brake, keep the tow rope tight and react to the movement of the towing vehicle, so the same requirements apply to them as to every driver - being sober and having the right to drive that vehicle. The popular belief that "you do not drive a car on a tow" is false; an intoxicated driver of a towed car is liable as for drink-driving, and the person towing is also liable for breaking the ban on towing. The state after drinking alcohol starts at 0.2 per mille. If the friend whose car you want to tow has been drinking, you call a tow truck with a platform - on a platform truck nobody is driving the car, so the driver's state does not matter.

Legal basis: Art. 45 para. 1 point 1 and 2 and Art. 31 para. 1 point 3 of the Road Traffic Act (Prawo o ruchu drogowym)
