In this situation, should the driver anticipate that a child might suddenly run onto the road from behind the vehicle?

Show the correct answer

Correct answer

YES

Explanation

In the photo you can see a narrow street in a housing estate, where a red passenger car is parked partly on the pavement, and behind it, on the pavement, an adult is walking with small children on bikes. In this situation the driver should anticipate that a child may suddenly run onto the roadway from behind the vehicle - the answer is YES.

The Road Traffic Act allows you to expect that other road users will obey the rules, unless the circumstances show that they may behave differently. The parked car hides the children from you, and you from them - a child may run or ride out from behind it onto the roadway before you have time to notice them. Small children do not judge the distance and speed of vehicles well and often act on the spur of the moment. That is why you drive past at a low speed, as far away from the parked car as possible, and are ready to brake immediately.

Legal basis: Art. 4 and Art. 3 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
