Question no. 11213 3 pts basic AM

Are you obliged to maintain cautious approach towards pedestrians walking on the pavement?

Show the correct answer

Correct answer

NO

Explanation

In the video we are riding a moped along a street in a town; in front of us an adult is walking along the pavement in the same direction, holding a child by the arm. You are not obliged to apply limited trust towards pedestrians walking along the pavement - the answer is NO.

The principle of limited trust comes from the Road Traffic Act, which allows you to assume that other road users follow the rules, unless the circumstances show that they may behave differently. A pedestrian walking correctly along the pavement, away from the roadway, does not in itself give a reason for such a suspicion, so you may assume that they will behave in line with the rules. The duty of limited trust arises only when something points to a risk - for example a child pulls away from the adult, or someone approaches the edge without looking at the road. Even so, you keep watching your surroundings.

Legal basis: Art. 4 and Art. 3 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
